Trademarks

The Foundations Group (TFG) acknowledges that all of the following are trademarks of Paramount Pictures, CBS Studios, or affiliated company (heretofore referred to as Viacom Affiliates):

- Star Trek, Star Trek: The Next Generation, Star Trek: Deep Space Nine, Star Trek: Voyager, Star Trek: Enterprise, Star Trek: The Motion Picture, Star Trek: The Wrath of Khan, Star Trek: The Search for Spock, Star Trek: The Voyage Home, Star Trek: The Final Frontier, Star Trek: The Undiscovered Country, Star Trek: Generations, Star Trek: First Contact, Star Trek: Insurrection, and Star Trek: Nemesis (collectively defined as "Star Trek works").
- All names, titles, and registry marks seen on the various Star Trek series.
- All other qualifying marks, words, or logos seen on the various Star Trek series.

TFG offers no suggestion that the work presented on this web page is "official" or produced or sanctioned by the owner of the aforementioned trademarks. In order to comply with United States Trademark Law, all materials produced by TFG will identify themselves as unofficial fan works. TFG will take all steps necessary to ensure that any usage of trademarked items in no way confuses the audience of this site as to its origin.

Copyrighted Works

TFG acknowledges that all of the following are copyrighted works of Viacom Affiliates:

- All video that is a part of any of the Star Trek works.
- All promotional pictures produced for any of the Star Trek works.
- All promotional videos produced for any of the Star Trek works.
- All other works produced while a salaried employee or contracting for a production which is a part of the collective Star Trek works.

TFG will make every effort to comply with United States Copyright law, and will only use copyrighted works if TFG believes that such use is excepted from prohibition by the Fair Use clause of United States Copyright Law.

Works created by TFG are more likely to qualify for Fair Use exemptions than the typical work.

First, TFG work for no profit. In fact, members of TFG take a loss for the production of its works, and no money is charged or received by TFG for any service or product. Put simply, I'm not making money, it's actually costing me money for hosting, and this is hardly a professional production - it's a group of fans doing something they love, simply for the love of doing it.

Second, the amount of the work used by TFG is always extremely limited. Sometimes, a still image from an episode may be used (one of tens of thousands of images in the entire work), or a small part of a given image may be used. True, we're also using a good deal of ideas, but I submit that this is a given because of what exactly Foundations is about. It's a remake of the series Star Trek: Enterprise, which means that we're going to be somewhat heavily influenced by it.

Third, TFG does not intend, nor believe it to be likely for the usage of copyrighted materials as part of TFG's works to cause a decline in the potential market for the work. In fact, TFG's productions will likely cause an increase in interest for the properties of Viacom Affiliates, as the audience for TFG's works will either be persons who already have an intense interest in the works of Viacom Affiliates, or much needed additions to the fan-base that Viacom Affiliates would no doubt appreciate for any future works.

I suppose I could really argue Fair Use exemption all I want, but it really won't matter if Paramount, CBS, or some other Viacom Affiliate wanted to come after Foundations for some breach in copyright law. So let's put it this way, the simple, blunt, straightforward and no bull way: it would be a complete and utter waste of time and resources to do so. Anyone who’s a part of TFG is going to be poor, including myself, who is simply a poor college student. Suing me would be like trying to get water out of a well that's been dry for decades, and just as pointless. Plus, it would piss off your own fan-base something fierce, especially on account of a certain agreement that took place in 1998 where Paramount basically agreed that it would be counter-productive to sue its own fans for showing their enthusiasm for their product when no money is being made to begin with.

Belief of Infringement

TFG requests that in the case that the owner or owners of a copyrighted work feel that their work is being illegally infringed upon, they provide a full list of all items which they believe are infringing, along with the reasoning behind the belief that those items are infringing to: foundations[at]cidvision[dot]com

In addition, please provide the name of a person, along with their email address or a mailing address, for a reply or follow-up letters.

Properties of The Foundations Group

The Foundations Logo and the actual written work of TFG are Copyrighted to The Foundations Group. However, TFG does not submit nor imply that the usage of Star Trek implies that the Foundations project is a part of the official Star Trek works.

All images, text, and other works presented on this web page are Copyrights of The Foundations Group, as are the actual episodes. All original names, logos, and marks are trademarks of TFG.

The Foundations Group Defined

Members of TFG are defined as unique persons who have access to the Star Trek: Foundations Development Forums. Permission to join TFG will be granted by a consensus of the Executive Staff.

All decisions made by TFG are made by consensus of the entire staff. The Executive Producer, or in the absence of an Executive Producer, the highest ranking member of the Executive Staff, can override any decision made by the staff of TFG. In the absence of an Executive Staff, the existing staff will appoint members of the Executive Staff by consensus.
